General Terms and Conditions
Terms of Service for the Frame4Life booking platform — Version of 3 July 2026
§1 Scope of Application
art trash GmbH, Boschstr. 12, 82178 Puchheim bei München, Germany (hereinafter "we" or "us") operates frame-for-life.com, an online platform that connects clients ("Client") with independent photographers and videographers ("Photographer") worldwide. These General Terms and Conditions govern the use of the platform and the mediation of bookings ("Booking") concluded via frame-for-life.com. We are not the provider of the photography or videography services themselves. The Cancellation Policy and the Privacy Policy published on this website form an integral part of these Terms.
§1a Our Role: Booking Platform
The contract for the performance of the photoshoot is concluded directly between the Client and the selected independent Photographer. The Photographer is solely responsible for the performance, quality, editing and delivery of the photoshoot. Our services are limited to: presenting photographers' portfolios and typical packages, forwarding booking requests, facilitating communication between Client and Photographer, and providing booking support. Photographers listed on the platform are independent contractors; they are neither employees nor agents of art trash GmbH.
§2 Conclusion of Contract
The presentation of photographers and packages on the platform does not constitute a legally binding offer. By submitting a booking request, the Client makes a binding offer to conclude a photoshoot contract with the selected Photographer. The contract between the Client and the Photographer is concluded when the Photographer accepts the Booking. The Client then receives, on the Photographer's behalf, a confirmation email containing the Photographer's details and the meeting point.
§3 Execution of the Photoshoot and Punctuality
The customer is obliged to arrive at the agreed meeting point on time (15 minutes prior to the session). Delays caused by the customer will be deducted from the booked shooting time. If the customer is more than 30 minutes late without notice, the session is considered canceled by the customer and subject to the cancellation fees. In case of bad weather, the photographer and the customer may agree on an alternative location (e.g., indoors) or reschedule the shoot if both parties are available.
§3a Conduct, Locations and Minors
The Client is responsible for their own conduct during the session. The Photographer may terminate a session without refund if the Client behaves abusively, is significantly impaired by alcohol or drugs, or requests unlawful actions (e.g., entering restricted or private property without permission). Entrance fees, permits or tickets required for chosen locations are borne by the Client unless agreed otherwise. Compliance with local laws at the shooting location (including drone regulations, where applicable) is the responsibility of the Photographer and the Client as the parties present on site. When booking a session involving minors, the Client confirms that they are the minor's legal guardian or have obtained the legal guardian's consent to the photoshoot and to the processing of the minor's images.
§4 Payment Terms
To secure a booking, a 20% deposit of the total package price is required. Unless otherwise agreed (e.g., for Gift Cards), the remaining balance is paid by the Client directly to the Photographer at the meeting location before or after the photoshoot. The prices shown on the website are the typical package rates of independent photographers in the given city; the final package and price are those confirmed in the booking confirmation.
§4a Rescheduling and Force Majeure
If the session cannot take place for reasons beyond the parties' control (e.g., severe weather conditions, flight cancellation, unexpected closure of the location, official orders), the Client and the Photographer shall first attempt to agree on a new date or an alternative location. If rescheduling is not possible, the Booking is cancelled free of charge and any booking deposit already paid is refunded in full. If the Photographer cancels a confirmed Booking for reasons within their control, we will endeavour to arrange a comparable replacement photographer for the same date at the same price and conditions; this matching service is provided at no additional cost to the Client. If no replacement can be found, any payments already made by the Client for this Booking (including any deposit and platform service fee) are refunded in full. Further claims against the platform are excluded to the extent permitted by law.
§5 Copyright and Right of Use
The photographer retains the copyright to all created images. Upon full payment, the customer receives the simple, non-exclusive right to use the photos for private, non-commercial purposes (e.g., personal social media, private prints). Any commercial use, resale, or distribution requires prior written consent. Unedited raw files (RAW) are not handed over to the customer.
§5a Use of Client Images in Portfolios and Marketing
Photographs showing the Client will only be published in the Photographer's portfolio or in the platform's galleries and marketing materials if the Client has given separate, explicit consent (§ 22 German Art Copyright Act — KunstUrhG). Such consent is voluntary, is not a condition for booking, and may be revoked at any time with effect for the future; upon revocation, the affected images will be removed from platform-controlled media within a reasonable period.
§6 Artistic Freedom and Liability
The Client acknowledges that photography and image editing are subject to the artistic freedom of the Photographer. Complaints based on differences in artistic taste, choice of locations, or editing style do not justify a refund. The Photographer, as the Client's contractual partner, is solely responsible for the performance of the photoshoot contract. Our liability is limited to the platform services we provide (mediation of bookings and booking support); in this respect, we are liable only for intent and gross negligence. Liability for simple negligence is limited to the breach of essential contractual obligations (Kardinalpflichten) and, in such cases, to the foreseeable damage typical for this type of contract. Liability for injury to life, body or health remains unaffected.
§6a Delivery of Photos, Complaints and Late Delivery
The Photographer delivers the edited photos within the delivery period stated in the booking confirmation. Complaints regarding the number of delivered photos or technical defects (e.g., corrupted files, missing gallery access) must be addressed to the Photographer in writing within 14 days of delivery. The Photographer is first entitled to remedy the defect (subsequent performance, e.g., re-delivery or replacement of affected images) before any price reduction or refund can be claimed. If delivery is delayed, the Client shall grant the Photographer a reasonable grace period of 14 days; claims arising from late or non-delivery are directed against the Photographer as the contractual partner. Repeated or serious delivery failures may lead to warnings or removal of the Photographer from the platform.
§7 Gift Cards
Gift cards are issued by art trash GmbH and can be redeemed for bookings via the platform for the specific city selected at purchase. Gift cards are valid for three years from the end of the year in which they were purchased (§ 195 German Civil Code — BGB). Cash payout of gift card values is excluded; statutory rights remain unaffected.
§8 Consumer Information and Right of Withdrawal
Pursuant to § 312g para. 2 no. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for services related to leisure activities that are provided on a specific date or period. However, we offer a voluntary contractual cancellation policy. Details can be found in our Cancellation Policy.
§8a Complaints and Disputes between Client and Photographer
Complaints regarding the performance, quality or delivery of a photoshoot must be addressed to the Photographer as the Client's contractual partner. Upon request, we voluntarily assist both parties in resolving disputes: we forward communications, verify booking records, and may issue warnings to photographers, remove reviews proven to be false, or remove a photographer from the platform. This assistance is a voluntary service of the platform and does not constitute an assumption of liability for the Photographer's performance.
§8b Reviews and Ratings
Reviews and ratings may only be submitted by Clients whose Booking was actually completed via the platform. Reviews must be truthful and must not contain unlawful, defamatory or unrelated content. We do not verify every review in advance, but we will review reported content and may remove reviews that are demonstrably false, unlawful, or unrelated to a completed Booking. Photographers cannot pay for the removal or alteration of genuine reviews.
§9 Dispute Resolution
With regard to disputes concerning our platform services, we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). Disputes concerning the performance of the photoshoot itself are a matter between the Client and the Photographer (§8a).
§9a Data Protection in the Booking Process
To perform a Booking, we transmit to the selected Photographer the data necessary for the session (in particular name, contact details, date, package and session notes) on the basis of Art. 6 (1) (b) GDPR. Where the Photographer is located outside the European Economic Area, this transfer is necessary for the performance of the contract requested by the Client (Art. 49 (1) (b) GDPR). The Photographer processes this data as an independent controller exclusively for the preparation and performance of the booked session. Any use for other purposes is prohibited; in particular, the Photographer may not use the data for own advertising or marketing, may not sell, rent out or otherwise disclose it to third parties, and may not add it to own mailing lists without the Client's separate consent. After completion of the Booking, the Photographer must delete the Client's data unless and for as long as statutory retention obligations (e.g., tax law) require otherwise. Violations lead to warnings or removal from the platform. Details on data processing can be found in our Privacy Policy.
§9b Changes to these Terms
We may amend these Terms for the future, in particular to reflect changes in law, new platform features or payment methods. The current version is published on this page with its version date. Each Booking is governed by the version in force at the time the booking request is submitted.
§10 Final Provisions
The law of the Federal Republic of Germany applies. If the customer is a consumer, the mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected (Salvatorische Klausel). These Terms are published in several languages for convenience: for users habitually resident in Germany, the German version prevails; for all other users, the English version prevails.
